County Engineer Ryne Thornburg told the Board that adjoining landowners and affected utilities had been notified by certified mail ahead of the public hearing. During the hearing, landowner Allan Netolicky raised whether he would retain access to his property if the road were vacated; Alica and Eric Bales sought clarification about the notice they received. Attorney Rick Lynch, representing Legacy Farms of Iowa LLC, asked that the vacation begin at a different legal corner so his clients would retain access to fields along 260th Street. The resolution text notes that ITC Midwest and Alliant Energy have utilities in the present right-of-way and that Iowa law preserves utilities' rights to remain in possession and to reasonable access.
