Council adopted Resolution 25‑07, approving a first amendment to the declaration of easements, covenants, conditions and restrictions between the city and CP Commercial LLC to add a public access easement and remove Tract B. Community Development Director Donna Ferguson said the amendment is necessary to allow a required access drive to be constructed and opened to the public in connection with an approved site improvement plan for a proposed Castle Pines self‑storage project (Parpa Plaza).
Ferguson described the exhibit and said the existing dashed green line in the plan shows an easement where an access drive has not yet been built; the amendment would add a public access easement in the same utility/emergency access area currently outlined in red. Legal counsel Linda confirmed there were no conflicts of interest and noted initial construction costs for the access drive are covered under the site's SIPIA with CP Commercial.
Council discussed whether the change could affect ongoing litigation; Linda said the amendment would not affect pending litigation. Several council members raised questions about public notice and how a prospective buyer would learn of maintenance responsibilities; staff said that purchase and sale due diligence documents would disclose the relevant agreements. After deliberation the council moved, seconded and approved the resolution on the record.
