Council postpones easement amendment after public concerns about notice, optics and litigation ties

Council moved Resolution 25‑07 — a proposed first amendment to recorded easements, covenants, conditions and restrictions between the city and CP Commercial LLC — from the consent agenda for separate discussion Tuesday and ultimately postponed consideration to Feb. 11, 2025.
Staff said the amendment would expand the existing internal access easement in a small subdivision in the southwest part of Castle Pines to reflect the as‑built internal drive and provide shared access and emergency access to several lots. Staff said South Metro Fire had reviewed the drive and the expansion aligns on‑site circulation for fire and lot access.
Multiple council members and members of the public raised procedural and optics concerns because the city is concurrently in litigation with CP Commercial over an adjacent lot and because the council previously authorized the city to act as manager in related property matters. Council member Deborah Mulvey asked for legal review of whether designating or changing a maintenance director and the city's role could create a pecuniary interest; members requested staff and the city attorney provide clarifying documents and legal opinion before final action. After debate the council voted to postpone the resolution to the Feb. 11 regular meeting to allow staff and legal to provide the requested documents and clarifications.
