Commissioners review Old Fort Ranch development agreement and direct attorney to revise draft

Kane County commissioners reviewed a proposed development agreement for the Old Fort Ranch property (parcels 4-7-2-1 and 4-7-3-1A) during their April 28, 2026 meeting in Kanab. Chair Gwen Brown led discussion with applicant Greg Wyatt and County Attorney Jeff Stott; commissioners gave informal approval for Stott to revise the draft and forward it to Wyatt, with an eye toward subsequent review by Kanab City and Planning & Zoning on May 13.

Attorney Jeff Stott described a set of suggested revisions the board discussed, including removing the draft's Section 3.10 (annexation language), changing transfer language to allow the applicant to transfer the agreement to a third party after a hotel occupancy permit is issued (provided the county is given notice), and splitting mediation provisions only if both sides agree. Chair Gwen Brown said the changes should be prepared and returned to the applicant; "all commissioners were in favor of this," the minutes record. Once Wyatt returns the revised document the attorney said he will send it to Kanab City for its review before it comes back to the county commission.

The session was labeled informal and nonbinding: the board sought an indication of support to get the document into a form acceptable to Kanab City and Planning & Zoning, not to approve a final agreement.
