City counsel advised that the appropriate procedure would be to enter a closed session under the state's open‑meetings statute to discuss collective bargaining strategy and suggested the council use subsection (b) for that purpose. A council member moved to enter a closed session for 20 minutes, stating: "I'll make a motion to take this into a closed session." The mayor noted the meeting required a second and a vote; following the procedural steps the mayor stated "Motion carries" and the council cleared the room to begin the closed session. No public vote on the contract was taken during the study session.
Council counsel also mentioned that if a Teamsters representative (Rick Salinas) was present, the council could allow that person to speak in open session before proceeding to a closed session. The council proceeded to a closed session limited to bargaining negotiations and did not announce a final outcome before recessing.
