Rick Carpenter reported that the seawall at Conroy Court (parcel 1636292) has failed multiple times, most recently washing out after heavy rains following Hurricane Helene. The seawall blocks now sit precariously above a recently repaired private 4‑inch metal sewer line; staff warned that if the blocks shift the sewer could be damaged, increasing inflow/infiltration risk and potentially requiring town remediation.
Carpenter said prior unpermitted work included demolition of a boathouse, and that the creek has repeatedly rerouted, undermining previous engineering attempts. Staff noted that North Carolina General Statute allows a 60–90 day process for condemning unsafe buildings and structures and that the town can issue citations or remove structures at the owner's expense if the owner fails to comply. Commissioner Scott Doster moved to proceed with condemnation and remediation within 90 days; the motion passed unanimously.
