The Notus City Council opened a public hearing on a proposed Accessory Dwelling Unit (ADU) ordinance—proposed changes are framed under Notus City Code Title 9 – Zoning Regulations—but no members of the public signed up to speak. The council reviewed one written comment that had been submitted and then closed the hearing.
During council review, members discussed key provisions in the draft ordinance: how to define an 'improved' parking space for ADU calculations; enforcement mechanisms including a potential fine of $100 per month and whether the city could suspend or revoke a certificate of occupancy for noncompliance; and an application fee designed to cover staff and professional review costs. The council noted that adding a new fee to the municipal schedule would require a separate public hearing and formal adoption before the fee could be charged. No vote on the ordinance or fee schedule occurred at the meeting.
The mayor and council did not adopt the ordinance on Aug. 4; staff and council will need to resolve definitional language and the procedure for adding fees before returning the item for further consideration.
