Neighbors urge Planning Board to press building commissioner for parking determination

Residents asked the Falmouth Planning Board on July 28 to delay action on a proposal that includes new parking until the building commissioner issues a formal determination on whether the use is allowed as of right. One speaker said the zoning board had been told a determination already existed, but a subsequent letter from the building commissioner says no such determination was made.
“...the building commissioner did respond through 2 letters to the ZBA, where he declared that he had made no such determination and that he was not intending to do so,” a resident said during public comment, urging the planning board to either ask the building commissioner to rule or deny the application if no determination is forthcoming. The resident also told the board that a 2.5‑acre site at 64 Tech Drive, zoned light industrial and roughly 1,500 feet from the current operations, would be a safer place for the business to expand.
Cynthia Borgier, who said she attended the March 17 hearing, told the board she has a copy of the building commissioner's letter and that continuing without that underlying determination may exceed the planning board’s authority. The board did not take final action on the application that evening; public comment on this matter predated several agenda items and the board moved into its scheduled business.
