The Middletown Fair Rent Commission discussed proposed clarifications to its bylaws aimed at aligning internal timelines and defining what happens when housing ownership changes.
A commissioner flagged three possible edits: change a 60-day timing provision to 30 days for consistency with the ordinance, specify whether a change in building ownership requires substitution of the new owner in pending matters, and clarify whether a complaint withdrawn by a tenant can leave a commission-held retaliation claim. Chair Rakim led the discussion and said the first two changes "probably make perfect sense" and could be considered for a vote at a future meeting.
Commission counsel advised that the commission should review the legal footing before proceeding. He said the withdrawal question "depends on what the alleged facts are" and noted the need to consider whether the commission has authority to pursue a retaliation claim after a complainant withdraws. Members agreed to have counsel examine the issue and return with a recommendation at a later meeting. The commission did not adopt any bylaw amendments at this session; members said they expect to take up formal votes once counsel reports back.
