Board member moved to approve the variance "subject to written commitments mutually agreeable between the city of Noblesville and the drainage board with outlet permit and connection allowed upon full documentation and sign off." The motion was seconded and carried without recorded opposition. Deputy Mayor Matt Light told the board the city is prepared to accept conditions consistent with prior approvals: "I'm Matt Light, deputy mayor for the city of Noblesville... If it's consistent with what was said previously, yes, we could." (Matt Light, deputy mayor.)
County staff said the variance responds to detention and release-rate needs for the project; they noted draft conditions would be similar to those used for a nearby Stony Creek townhome project and that the board would retain final control of the outlet permit pending completion of paperwork. The board required that commitments be finalized in writing and documentation be signed before the outlet is connected.
The decision followed staff and petitioner discussions about holding the county harmless for pollution beyond stormwater discharge and ensuring compliance with a previously referenced Firestone EPA mitigation plan from 2006. The board took the action after no public objections were raised during the discussion.
