MDAR orders removal of dumped material at 132 River Road; commission defers enforcement for now

Chair Scott Jackson reported an update on prior discussion of dumping in the Riverfront Area at 132 River Road (Helstowski). Jackson said the Massachusetts Department of Agricultural Resources (MDAR) has taken enforcement action requiring that the dumped material be removed from the Riverfront Area "to the maximum extent feasible." Conservation Agent Kelly Kowal provided an update on conversations with the landowner. The commission decided that no formal enforcement action under the Massachusetts Wetlands Protection Act is currently needed, but that enforcement could be initiated in the future if the landowner does not comply with MDAR’s requirements.
The commission recorded MDAR's involvement and may revisit enforcement depending on the landowner's compliance with the state agency's order.
