Commission declines immediate action after reported beaver-dam breach near Routes 5&10 and Christian Lane

An email from Fran Fortino on behalf of the Whately Board of Health reported that someone had breached a beaver dam near the intersection of Routes 5&10 and Christian Lane without approval from the Conservation Commission, which the BOH considered a potential violation of the Massachusetts Wetlands Protection Act. Chair Scott Jackson said he contacted Garrett Barry of the Whately Highway Department and Tom Kozik of MassDOT; both said they knew nothing about the breach.
MassDOT told the commission it is consulting Beaver Solutions about whether installing a water-flow device could help address culvert blockages caused by beavers. Because the commission does not know who breached the dam and because mitigation work by others may be forthcoming, the commission decided to take no enforcement action at this time and asked Conservation Agent Kelly Kowal to monitor the situation.
