Applicant withdraws Notice of Intent and plans DCR Forest Cutting Plan for 98 Chestnut Plain Road

At the June 17 meeting the commission heard a continuation of a public hearing on a Notice of Intent filed by Joya Casey to control invasive plants at 98 Chestnut Plain Road. Ry Patton, representing the applicant, told the commission he had spoken with the Massachusetts Department of Conservation and Recreation (DCR) service forester for Whately, who indicated that the proposed work could be covered by a DCR Forest Cutting Plan and therefore be exempt under the agricultural exemption of the Massachusetts Wetlands Protection Act. The applicant stated they intended to withdraw the Notice of Intent and file a Forest Cutting Plan with DCR instead.
The commission recorded the applicant’s plan to pursue the DCR process in place of the local Notice of Intent and did not vote to take enforcement action related to that filing. The procedural change means the proposed vegetation work would move to the DCR Forest Cutting Plan pathway rather than continuing under the commission’s Notice of Intent review.
