Neodesha commissioners adopt charter ordinance allowing flexible official notice publication

The Neodesha Board of Commissioners approved Charter Ordinance No. 20 on Jan. 28, 2026, a measure that exempts the city from K.S.A. 12-1651 and gives the governing body authority to designate one or more newspapers or websites as the official city newspaper(s) for publishing legal notices. Administrator Jones presented the ordinance and commissioners voted to adopt it.

The charter ordinance text says the Governing Body "shall designate from time to time by resolution one or more newspapers and/or websites as the official city newspaper(s) of the City for publication of legal notices." It specifies that any currently designated official city newspaper remains so until changed by resolution, requires publication of the charter ordinance in its entirety once each week for two consecutive weeks in the official city newspaper, and directs the city clerk to record the ordinance and file a certified copy with the Kansas Secretary of State upon its effective date. The ordinance takes effect 61 days after final publication unless a sufficient petition forces a referendum.

Commissioner Banzet moved to approve Charter Ordinance No. 20 as presented; the motion carried. The ordinance explicitly references state law by name: K.S.A. 12-1651. The adoption creates a formal process the city will use to designate legal notice outlets if the Neodesha Derrick is unable to publish.
