Counsel, engineer give mixed views on road ownership and wetland maintenance

District counsel and staff discussed whether the Village of Estero or the county is responsible for a road west of U.S. 41 to the clubhouse; counsel will send a letter to clarify ownership. The district engineer also reported possible damage to a flow-way plug and will coordinate repairs.
Lenore Brakefield of Woodward Pires & Lombardo told the board that the Village of Estero's stance is it does not need to maintain the road west of U.S. 41 to the Clubhouse. District Counsel Tony Pires said he thinks the County is responsible and said he will send a letter to the Village of Estero and the County’s counsel; Operations Manager Shane Willis said he had emailed Johnson Engineering documents to Mr. Pires on Nov. 20, 2024.
District Engineer Charlie Krebs reported a few line-of-sight landscape issues and said he believes the plug separating two flow-way basins may have been damaged during flow-way clearing; Mr. Long observed water coming into the flow way south of Pelican Sound Boulevard and Krebs will forward information to the district manager for MRI to review and re-establish the plug. The board also discussed vegetation near residences and the constraints on prescribed burns in residential communities; Ms. Adams said the district could consider clearing 30 feet of vegetation behind residences every three years subject to South Florida Water Management District approval.
