TDEC lowers max deductible for UST fund releases and extends fee suspension to 2031

Ally Williamson, legislative director for the Department of Environment and Conservation, described a rule from the Division of Underground Storage Tanks that reduces the maximum deductible for fund eligible releases from $30,000 to $5,000 and extends the suspension of annual tank fees through 06/30/2031.
"This change helps lower financial barriers and speeds up site cleanup," Williamson said, adding the rule also contains administrative clarifications and does not create or increase any fees. Deputy director Kate Harper said the deductible reduction includes incentives for equipment that is more protective of the environment and that the board retains authority to adjust fees if needed.
Members asked whether the suspension is open-ended; the director of the division, Stan Boyd, confirmed the board retains authority to raise, lower or suspend tank fees in the future and could revisit the suspension if circumstances change.
The Senate moved the rule out with a positive recommendation.
