TennCare rule clarifies institutional eligibility effective date to align with federal law

TennCare told lawmakers it is revising rules so institutional Medicaid eligibility may begin on an individual's date of confinement when all financial and technical eligibility criteria are met, aligning state rules with federal requirements and reflecting current agency practice, the department said.
Amanda Petrie, associate counsel with TennCare, explained a permanent rule amending institutional eligibility effective date language to align with federal law and current practices.
"This rule change actually will reflect current process and it will also align our role with federal law," Petrie told the committee, explaining that if technical and financial eligibility criteria are met on the date of admission in a medical institution, eligibility may begin on that admission date; otherwise eligibility begins when criteria are met.
Senator Oliver asked whether beneficiaries might be adversely affected by any waiting period between application and eligibility; Petrie said not to her knowledge and described examples where the rule allows TennCare to treat the admission date as the effective date when criteria were met at admission. The change also clarifies effective dates for home and community-based services consistent with federal rules.
The Senate moved the rule out with a positive recommendation.
