Planning commission recommends village board approve longer deadline, clearer test for conditional use permits

The DeForest Planning and Zoning Commission voted unanimously June 23 to recommend that the village board approve an ordinance amending Village Zoning Code Chapter 15 to change how conditional use permits terminate.
Mark, the planning staff member who presented the proposal, said the change would "extend the time frame to make a conditional use permit operational after it's approved from 1 year to 2 years" and would add a definition of "established," which he described as effectively being "open for business." He told commissioners that larger projects — for example a parcel delivery facility by Ryan Companies — often require more time than the existing one-year window allows.
Commissioner Mike moved that the commission recommend village board approval of the attached ordinance to adjust the timeframe and the termination criteria; Commissioner Caitlin seconded. With no discussion, the chair called for the ayes and the motion passed 6–0. The commission also noted that applicants may request additional extensions beyond two years, but those extensions would be at the commission's discretion.
The ordinance, if adopted by the village board, would not retroactively change deadlines for conditional use permits that already expired; those applicants will need to seek a new permit or extension if they choose to proceed. The commission closed the public hearing on the item at 6:06 p.m. and forwarded its recommendation to the village board.
