Air Pollution Control Board updates rules to adopt latest NESHAP standards and streamline asbestos filings

Emma Oosley, assistant director of legislation for TDEC, presented proposed revisions that incorporate by reference National Emissions Standards for Hazardous Air Pollutants (NESHAP) from 40 CFR Parts 61 and 63, add state‑specific forms for asbestos notifications and clarify inspection and visible emissions definitions.
Jimmy Johnston of the Division of Air Pollution Control said changes are principally organizational and update the state rules to the latest federal language while allowing electronic submittals to modernize the asbestos program. Members asked whether the update affects regulation of gas turbines at data centers and TDEC staff said the federal standards that apply to such turbines are already in state rules; local air agencies retain the authority to adopt standards that are at least as stringent as the state’s.
The committee recorded a positive recommendation and thanked the presenters.
