Virginia Tech board holds closed meeting for legal advice under Virginia FOIA
Summary
During its May 11, 2026 virtual meeting the Presidential Search Committee voted unanimously to move into a closed session to receive legal advice under §2.2-3711 of the Code of Virginia and later certified the closed session under §2.2-3712 upon return to open session.
Board member Nancy Dye moved that the Board convene in a closed meeting "pursuant to § 2.2-3711, Code of Virginia, as amended," for the purpose of receiving legal advice from University Legal Counsel Kay Heidbreder; J. Pearson seconded the motion and it passed unanimously. The livestream was suspended for the closed session.
After the closed session the livestream resumed and Nancy Dye moved a certification under §2.2-3712 of the Code of Virginia that the meeting had complied with the law; that motion was seconded by J. Pearson and passed unanimously, with the Board resolving that, to the best of each member's knowledge, only public-business matters lawfully exempted from open meeting requirements were discussed in closed session.
