Selectboard seeks VLCT guidance on liability after Act 162 allows municipal appointment of Forest Fire Warden

The Selectboard discussed changes under Act 162 and recently issued Vermont Forest, Parks and Recreation FAQs that clarify municipalities can appoint a Town Forest Fire Warden instead of the Fire Chief. The board agreed to hold off on sending a letter to the Governor until they receive guidance from the Vermont League of Cities and Towns (VLCT) on liability questions, including civil-liability exposure and responsibilities for burn permits.
Aileen Lem said the State no longer provides a stipend for Town Forest Fire Wardens but may cover certain costs per Act 162 and FPR FAQs; the State is also still setting up its data collection system and expects functionality in 2027. The Selectboard agreed it should appoint a Town Forest Fire Warden in partnership with the Fire Chief and Brenda F. offered to step into the role temporarily while a permanent replacement is sought. Aileen will follow up with VLCT and report back to the board.
