Council told HB 1183 removes city authority to require upper-level stepbacks for affordable housing

During discussion of multi-family infill code height, Director Meredith Penny alerted the council to recent state law changes. Penny said the Washington State Legislature passed HB 1183, which “prohibits cities from requiring upper-level setbacks (stepbacks) for affordable housing,” meaning the City cannot mandate those stepbacks and will instead propose distance-based recommendations.
Councilmembers discussed implications for local code but did not adopt any regulation at the meeting. Staff will return with recommended language that complies with HB 1183.
