Planning board recommends conditional-use permit for Rockland Stone quarry, 6-0 vote

The Lyon County Planning & Appeals Board recommended approval of Application Q2025-02 — a request by Rockland Stone for an Agriculture conditional‑use permit to operate a rock quarry in the east half of Section 31, Township 19 South, Range 10 East.
Chair Mike Langley called the public hearing on June 11. Planning Director Samuel Seeley presented staff’s recommendation to approve the permit, citing Section 2.5 (permitted industrial/resource extraction uses) and Section 7.17 (Quarry Regulations) of the county code and the goals of the county’s PlanELC land‑use plan. Seeley said the application included operational controls and a reclamation plan that staff judged suitable for a sparsely populated rural location.
Matt Miller, speaking for Rockland Stone, described the proposal as a “non‑blasting quarry, no crushing,” and said the company would secure insurance and bonds and complete reclamation. Miller said planned excavation would be limited to about 20 feet in depth and that trucks would use block scales. Owner Nate Passmore said the operation expects approximately "10 trucks per week" and noted there is an alternate route in Chase County if necessary. Board members also heard that Ashia Passmore said about two‑thirds of the workforce would come from Lyon County and that local contractors would be used.
The board discussed suggested permit conditions designed to address health, safety and infrastructure impacts. Conditions the board included in its recommendation were compliance with Section 7.17 (Quarry Regulations), a letter from the State Historical Society, proof that subcontractors are adequately insured, a cap on truck trips (no more than 15 trucks per week), completion of all studies required by law, and a $2 million liability policy as approved by the Planning Board.
Board member Robert Deiker moved to recommend approval with those conditions; Phil Mott seconded. The board voted 6-0 to recommend the conditional‑use permit to the Board of County Commissioners.
The board’s recommendation is advisory to the county commission; any permit issuance, permit conditions or additional requirements will be set by the commission and by code‑required review processes.
