Council, White Earth Nation discuss permitting for Withdrawal Treatment Center; zoning compliance remains next step

Mahnomen City Council reviewed submitted designs for the White Earth Nation (WEN) Withdrawal Treatment Center and agreed zoning compliance is the next procedural hurdle before permits can be issued. Administrator Taylor Guenther told council the city would have its zoning officer meet the construction contractor to determine code compliance.
The topic also prompted two special meetings in late May focused on relations with the band and permitting. At the May 26 special meeting, the council met with legal counsel and entered a closed session to discuss ordinance and zoning enforcement related to White Earth Nation; no formal action followed when the meeting reopened. On May 27 council members and WEN representatives discussed the band’s position that it would not submit permits for work within the city because of sovereignty concerns, and the parties agreed to compare permitting practices and explore a mutual process. According to the May 27 minutes, the band agreed to submit plans and specifications for further city discussion.
Guenther framed the conversation as a technical permitting and zoning issue, not a question of jurisdiction: the city needs to know intended use, setbacks, parking, utility connections and other code-related details before a permit can be evaluated. The council recorded no vote or regulatory action at the June 1 regular meeting; instead, staff will pursue a site-level review to determine whether the proposed use meets city zoning code requirements and will report back at a future meeting.
