South Ogden council weighs temporary moratorium while small-area plan is developed

Planning staff addressed the council on possible use of a temporary land‑use moratorium tied to the city’s small‑area plan work, saying the maximum moratorium under state law is 180 days and that its justification must show a compelling public interest.

"The most a moratorium could be is 180 days," the planner (addressed in the meeting as Matt) told the council, and explained that the moratorium must state the public‑interest justification, area of effect and effective dates. Staff said there is no statutory limit on the number of moratoriums in a year, but that complete applications submitted during an active moratorium would generally need to be approved if no new regulation is adopted before the moratorium expires.

Council members pressed staff on scope and timing, asking whether the pause should cover only the city‑center core or the broader small‑area plan boundary and whether the moratorium should target residential development only or include commercial projects as well. One council member said the small‑area plan work should be completed quickly so the city can adopt clear standards before new projects are built.

Mayor Russell L. Porter said the small‑area plan process typically takes about a year once a consultant is selected and asked staff to coordinate with legal counsel. Several council members expressed support for proceeding with the consultant selection and preparing moratorium language to consider at a future meeting.
