Neighbors prevail as ZBA denies proposed 6-foot front fence at Corn Valley Road

The Zoning Board of Adjustments declined to approve a variance that would have allowed a 6-foot solid wood fence across the frontage of 3602 Corn Valley Road, after multiple neighbors testified that the change would be out of character and could create safety and visibility issues.
Planner June presented the case and told the board that staff had sent 33 notices and did not object to the request "if boards choose to grant the request" provided the applicant obtains required building permits and code compliance. During public comment, long-time resident Marshall Warder told the board the requested solid fence would replace transparent wrought iron and argued it would be "not be aesthetically pleasing, will not be conducive to community interaction, and finally, will certainly not be neighborly." Several neighbors also raised concerns about the adjacent floodplain, sight lines near a school route and the precedent that approving the solid wood frontage would set for other corner properties.
Board members debated whether the lot’s orientation and historic lot configuration justified a front-yard exception. After the discussion the motion to approve failed; staff clarified that a failed motion results in denial. The board recorded the motion failure and denied CBA26030011.
