Board holds closed sessions on litigation and property sale; roll calls recorded

The Kalkaska County Board of Commissioners used two statutory exceptions to Michigan’s Open Meetings Act to meet in closed session during its Aug. 13 special meeting. On a motion by Commissioner David Comai, supported by Commissioner David Persons, the board entered closed session at 2:09 PM to discuss trial or settlement strategy in McKinnon, et al v. Kalkaska County, Case No. 24-14528-CZ, citing MCL 15.268(e). The board returned to open session at 2:31 PM.
Shortly afterward, on a motion by Commissioner Robert Baldwin (supported by Comai), the board entered a second closed session at 2:33 PM under MCL 15.268(d) to consider the sale of real property and requested that Realtor Bonnie Garrett remain. The meeting returned to open session at 3:05 PM, and subsequent motions recorded outcomes of actions taken or directed in closed sessions. Roll call votes for closed-session motions and subsequent actions were recorded in the minutes.
