The Kalkaska County Board voted to enter a closed session to discuss trial and settlement strategy in the pending litigation McKinnon, et al v. Kalkaska County Board of Commissioners, et al, Case No. 24-14528-CZ, citing MCL 15.268(e) as the statutory basis for the closed session. "Motion by Bicum to enter into Closed Session at 6:56 PM, to discuss with our attorney trial and/or settlement strategy in connection with the pending law suit McKinnon, et al v Kalkaska County Board of Commissioners, et al, Case No. 24-14528-CZ, pursuant to MCL 15.268 (e) since the discussion in an open meeting would have a detrimental financial effect on the litigation and/or settlement position of Kalkaska County," the minutes read. The motion passed on roll call.
After returning to open session, the Board approved a motion to designate Sheriff Patrick Whiteford and Chair Kohn Fisher to attend mediation in Grand Rapids on Aug. 5, 2025, and authorized counsel and other attendees to negotiate on the county's behalf. The Board recorded the dates and attendees and directed counsel to proceed consistent with the closed-session discussion.
