Planning commission backs rezoning of 514.2 acres to Agricultural Heritage Zone

The Box Elder County Planning Commission on May 21 unanimously voted to forward a recommendation to the County Commission to rezone about 514.2 acres north of Riverside and north of Plymouth from unzoned to the Agricultural Heritage Zone (AHZ). The application was filed on behalf of Capener Brothers Dairy LLC and Jeffrey Rigby.
County planning staff summarized the four statutory approval standards the commission must consider, including consistency with the County General Plan, compatibility with surrounding development, potential adverse impacts on adjacent property, and adequacy of facilities and services. Staff reported surrounding land uses are rural residential and agricultural.
Applicant Neil Capener urged approval in public comment, saying, “they are getting encroached upon by houses and would just like to continue farming.” After closing the public hearing, Commissioner Jed Pugsley moved to forward a recommendation of approval, Commissioner Jared Holmgren seconded, and the motion passed unanimously.
The commission attached the standard conditions of approval: compliance with Article 5 of the Box Elder County Land Use Management & Development Code; compliance with Section 2-2-080 (Zoning Map and Text Amendments); and compliance with all applicable county, state and federal laws and permits. The recommendation now goes to the Box Elder County Commission for a final decision.
