Hearing officer recommends Huachuca City amend zoning code to align home-based firearms rules with state law

At a public hearing on Feb. 19, 2026, in Huachuca City, Dr. Johnson, the town's hearing officer, recommended that the Town Council approve a text amendment to Section 18.100.210D(1) of the zoning code to align local rules on firearms-related home-based businesses with Arizona state law.
Dr. Johnson read the proposed replacement language aloud and explained that the amendment "is necessary to align the town code section 18.100.210 D (1) with state law concerning firearm related home based businesses and to further clarify what is prohibited." He told the chamber that the proposed text and related materials had been posted for public review and that a citizen review process has been under way since Feb. 5; he also said no written comments had been submitted.
Reading the draft ordinance language, Dr. Johnson stated: "The operation of a home based business involving the sale, mail order, trade, manufacture, display, storage or repair of any sort of explosive or improvised explosive device, and or prohibited weapons, as defined under ARS Section 13-3101." The language connects the town's prohibited activities to the statutory definition in ARS Section 13-3101.
Dr. Johnson opened the hearing for public input and invited individuals to speak; he then reported that no members of the public were present in the chambers—only Town Clerk Brandye Thorpe and Chief of Police Wyatt Barry were there—and closed the hearing. He said it is his recommendation to approve the amendment as written and that his recommendation and the hearing record would be forwarded to the Town Council for the council's final reading and decision. The hearing was adjourned the same evening; the minutes were later certified by Town Clerk Brandye Thorpe and approved by Mayor Johann R. Wallace on Feb. 26, 2026.
The council has yet to take a final vote. The change under consideration would make explicit in town code that the kinds of sales, manufacture, storage or repair tied to explosives and ‘‘prohibited weapons’’ (as defined in ARS 13-3101) are not permitted as home-based businesses; the hearing record shows no public opposition or additional clarifying detail submitted at the hearing.
