Town attorney to draft firearms-code amendments to conform with state preemption

At the Jan. 8 meeting, Town Attorney Thomas Benavidez told the council he would like authorization to prepare ordinances amending several municipal code provisions so the town’s ordinances align with state law on firearms preemption. Benavidez said some local code provisions currently prohibit activities that state law now allows.
Council approved a motion authorizing the attorney to draft the ordinances; no ordinance language was adopted at the meeting. Benavidez identified code sections under review as Section 18.100.210(D)(1) (Weapons Merchant Prohibited Home-Based Business Use), Section 9.20 (Minors Prohibited From Carrying Firearms) and Section 2.55.070 (Fees Chargeable By Police Before Firearms Transfer). The council’s approval was procedural authorization to begin drafting to ensure compliance with changes to state statutes.
