Huntsville officials review Powder Landing development agreement; no final vote

Huntsville Town officials convened a June 16 work session to review a proposed Development Agreement (DA) and rezoning request from Powder Beach LLC for a private, members-only facility called Powder Landing at 6510 East 100 South.
Town attorney Bill Morris outlined the DA's purpose as a contract to mitigate neighborhood impacts and explained zoning mechanics that would allow use limitations by agreement rather than a straight map amendment. "The DA is a contract and if they breach that then there will be fines," Morris said, describing the DA as a mechanism the town can use to enforce limits on events, parking and hours.
Morris also addressed a potential conflict of interest involving two council members, concluding there was no direct financial conflict: "They were not getting any money whether the DA was approved or not," he told the meeting. He advised members of the public to route questions through the clerks because Planning Commission members are quasi-judicial and should not be approached about the matter.
The draft agreement and its exhibits were discussed (see Attachment #1 and Attachment #2 in the record). Attendees and a circulated residents' flyer raised concerns about parking, shuttle operations, septic and stormwater plans, and whether the agreement provided public benefit. Morris suggested tabling the matter and holding a follow-up work session with Powder Mountain representatives to answer specific questions. The council did not vote on the DA at this meeting and adjourned at 5:15 p.m.
