The planning commission recommended approval of rezoning case 2025-15 and associated preliminary and final plats for property at 119 Central Avenue (the Buckshot Addition). Applicant representative Craig Bennett said the proposal consolidates two parcels, confines previously blanket 115 kV electrical easements with MPPD and cleans up legal boundaries to facilitate future development.
City staff confirmed the applicant withdrew a proposed Future Land Use amendment and recommended approval of rezoning to C3 and the platting as consistent with the 2016 comprehensive plan. Bennett noted recorded warranty deeds to Buckshot Farms showing clear title were a basis for MPPD's easement release.
Two letters from a neighboring property owner were submitted for the record raising a possible boundary dispute. City Attorney Mike Tai told commissioners, "this is not the the forum where a boundary dispute gets resolved," and advised the commission to evaluate the application on zoning and planning criteria; he said boundary issues would be litigated in court if necessary.
Motions to approve the rezoning and both plats were moved, seconded and approved by roll-call; the chair declared the motions carried. The commission's approvals are recommendations to the City Council for final action.
