The Kearney City Planning Commission voted to approve Easement Vacation 2025‑04, removing the north 10 feet of the east 890 feet of the utility easement on Lot 2 of Cherry Avenue Industrial Park, a parcel listed at 2915 Marshall Avenue.
Craig Bennett of Miller & Associates, representing the property, said the easement across the north side of the lot contains no active electrical infrastructure in the portion in question and that vacating it would clear constraints to future building placement near the Blueprint/OE Engines site. "So we're asking to vacate that utility easement that we have here," Bennett said. City staff recommended approval, writing that the easement limits building placement and that the vacation is consistent with the 2016 comprehensive plan; staff added they were not aware of any financial obligations to the city tied to the property. In the meeting staff stated, "The development service department is not aware of any financial obligations affecting the city that may be associated with this project, and staff recommends approval of the vacation of the utility easement as presented."
A commissioner moved to approve the easement vacation based on staff findings; the motion was seconded and passed on a recorded voice vote. Two members were noted as absent. The approval clears the easement from the plat and allows the applicant to pursue site development consistent with applicable building and utility permitting.
The commission’s action is a recommendation to proceed with formal recording steps as required; the applicant will return with any necessary plat corrections and permitting documents.
