Neighbor asks how to enforce a deed restriction; resident provides alternate AB zoning interpretation

During the meeting's public-comment period, Daniel Davies identified himself as the adjacent neighbor to a parcel previously considered for rezoning and said he formerly owned the land. Davies told the commission there is a deed restriction that limits the property to a single residence and asked what steps would be required to enforce that restriction.
Chair Judd McCormack and other commissioners noted that earlier denial decisions had referenced neighborhood character and road suitability in the prior consideration of the rezoning. Resident Matt Ubel said he interpreted the AB zoning district differently from staff and provided a handout to the commission proposing changes to AB regulations; Robert Busby indicated interest in reviewing Ubel’s suggested language during future deliberations.
The commission did not make a determination about deed-restriction enforcement at the July 16 meeting; staff and commissioners agreed to revisit Mr. Ubel’s proposed AB-district changes at the August 18 special meeting.
