Planning Commission approves rural-tourism conditional use permit with time and noise limits

The Pottawatomie County Planning Commission on July 16 approved a conditional use permit (CUP) to allow a rural tourism operation on a privately owned parcel, setting operating hours and an exterior noise ceiling as conditions of approval.
County Planner Bridget Snow presented the staff report explaining why the request is a CUP under the Unified Development Regulations and reviewed the five statutory factors the commission must weigh, including neighborhood character, adjacent land uses, and potential detrimental effects on nearby properties. Snow also outlined three specific requirements for rural-tourism CUPs: a detailed site plan, an operations and noise plan, and an approved wastewater connection or an individual wastewater system permitted by the County sanitarian and/or KDHE.
Applicant Steve Kaiser told the commission he had discussed wastewater arrangements with the County Sanitarian and that the proposed entrance is under review by the County Public Works Department. Commissioners focused on hours and noise control. Robert Busby suggested limiting hours so events end no later than midnight and proposed a noise maximum of 65 decibels measured at the nearest residence. Tatum Couture moved to approve the CUP with conditions setting hours from 6:00 AM to midnight and a noise limit of no more than 65 decibels at the nearest residence; Austin Vincent seconded, and the motion passed unanimously.
The permit includes the three rural-tourism conditions Snow described: the commission required a site plan showing buildings, roads and parking; an operations plan describing hours and expected noise; and proof of an acceptable wastewater system or KDHE-approved individual system before operation may commence. The commission did not attach additional restrictions beyond the hours and noise limit at the hearing.
The applicant and staff may return with clarifications or modifications consistent with the conditions; no appeal or further action was recorded during the meeting.
