John Hemmelgarn, Jay Portland Building & Planning Director, told the commissioners that construction for a proposed feed mill and biochar manufacturing facility could damage county roadways and recommended an agreement with the highway department requiring the developer to pay for repairs if they occur. Hemmelgarn told the board the developers would meet with the highway department but said, “the construction could potentially tear up the roadway and would like an agreement in place with the highway for them to pay for any repairs, before the BZA approves the exception.”
Commissioners discussed whether the agreement would be limited to construction impacts or extend to everyday use; County Attorney Wes Schemenaur advised talking with the owners first. Duane Monroe moved to authorize a discussion with the landowner regarding road use and a potential agreement; Doug Horn seconded and the motion passed unanimously. No formal agreement was adopted at the meeting; the action authorizes staff and commissioners to pursue terms with the landowner prior to BZA action.
