Commission approves easement vacation to allow full building on Turkey Creek lot

The Kearney Planning Commission voted to approve an easement vacation that will let property owners build across Lot 1 of Turkey Creek 3rd Subdivision at 2105 West Tallmadge Street.
Craig Bennett, with Miller and Associates, told the commission that the electrical utilities originally in the plotted 10-foot utility easement have been relocated and that removing the easement would allow the owner to build across the entire lot. "The electrical has been relocated to that easement there," Bennett said, explaining the easement no longer limits development.
City planner Melissa Durbia O'Hara recommended approval, saying staff found the vacation consistent with the comprehensive plan and that utilities can now support building placement. After Bennett and staff answered commissioners' questions about how the easement had been realigned historically, a motion to approve easement vacation #2025-03 was moved, seconded, and approved by voice vote.
The approval clears the plotted utility easement from the recorded plat and lets the owner pursue building permits consistent with local development rules. Staff will enter the approved vacation into the city’s records and advise the applicant on any remaining permitting steps.
