North Bay Village code staff reported that an underground fiberglass pool installed at 1540 North Treasure Drive does not meet the zoning setback requirements and that no variance application could be located in village records. The code director recommended the owner obtain the required permit or variance; fines of $250 per day were reported to have accumulated since Aug. 15, 2024.
Owner Julio Alonso told the hearing he has documentation ready and will contact building staff to determine what is missing and obtain necessary approvals. Maria Tovar, the court officer who presented the case, recommended the fines continue to accumulate until the matter is resolved and for the owner to return for an update if necessary.
Next steps: the owner will check with the building department and zoning office about any outstanding variance application or permit requirements and report back to village staff.
