The Planning Commission approved deviations for the Frank Thompson property at 8133 Overland Park Drive to allow two accessory garages that together exceed the code‑allowed accessory square footage by 174 sq ft and to permit a fence that encroaches on the sidewalk/right‑of‑way area.
Staff outlined the code requirements and recommended approval with stipulations A–C pending building‑safety review and potential removal of some concrete surface to meet impervious‑area standards. Applicant counsel Greg Musil said the principal structures date from 1927 and argued that requiring removal or drastic alteration would be an unfair consequence for a historic feature; he noted the owner already removed a shed and restored sod in one area.
Neighbors and nearby property owners spoke in favor of the deviation, citing careful maintenance and the property’s historic character. Steve Lobdell, who lives across Hamilton Street, said the street layout makes it appear that the city’s right‑of‑way, not the garage, is at issue: "The garage was not put too close to the street," he told commissioners.
Commissioners emphasized the need to work through building permits and confirm code compliance for the accessory structures and fence; staff said building safety inspections will determine any required repair or modification. Commissioner Robinette moved to approve the deviations with stipulations; the motion passed 9–0. The item will proceed to City Council on Aug. 3.
