At the Nov. 3 meeting the Notus City Council discussed a proposed Latecomers Agreement brought up by a developer planning a new well for a subdivision.
According to the minutes, the developer is asking that 50% of connections outside of the subdivision be included in the recovery calculation, that recovery be allowed over a 15'120-year timeline, and that the developer be granted a waiver of water connection fees inside the subdivision. Council members noted the new well must be operational before the first outside connection is made, that plans require approval by the Idaho Department of Environmental Quality (DEQ) and the City, and that the developer may not collect more than the actual cost of the well. The minutes specifically state current residents are not to pay for the new well.
City Attorney Ben Layman was directed to make changes to the agreement language and return the revised draft to council for further consideration; the minutes do not record a vote on the agreement at this meeting.
