Engineer previews state stormwater rules; borough to adopt required ordinances by July 20

At the May 12 work session Eric Keller, Borough Engineer, briefed council on changes to the state stormwater and floodplain management rules that the Borough must incorporate.
Keller said the state adopted a stormwater revision on Jan. 20 that becomes effective July 20, 2026, and provided sample ordinances the Borough must adopt to remain compliant. He identified two mandatory ordinances — a tree ordinance and privately owned salt-storage controls — and a third optional ordinance concerning refuse containers/dumpsters. Keller said the sample ordinances can be tailored but cautioned that their protections "cannot be weakened that are set forth there in." Administrator McNeilly asked Keller to send electronic copies of the draft ordinances to the administrator and the borough attorney; council agreed to review the materials at the June work session and introduce the ordinances later in June.
Keller further warned that projects submitted after the effective date will have to comply at the municipal level: "When the Flava application on Sparta Road is received, they will have to comply because the residential site improvement standards, by reference, adopts the latest stormwater regulations." The council directed staff to circulate Keller’s samples and to prepare ordinance language for introduction.
