By interpreting the proposed cannabis microbusiness as a manufacturing use, the Zoning Board of Appeals set the applicant on a path that requires formal review by the Common Council and Planning Commission.
Staff (S2) and Jean (S3) told the board that a positive interpretation does not bypass permit review: rather, it determines the applicable permit category. Chair (S1) and other members emphasized that the special-permit process allows the Common Council to impose detailed conditions addressing parking, loading, ventilation, screening, hours of operation and other neighborhood protections. The board recorded that many operational and mitigation specifics — notably ventilation/odor mitigation, delivery logistics and screening for the building’s rear lot and propane tanks — will be examined at those hearings.
The board asked applicants to prepare and present additional documentation (equipment cut sheets, ventilation/odor mitigation plans and delivery schedules) when they appear before the Common Council and Planning Commission. The ZBA forwarded its interpretation and supporting documents to staff for inclusion in the record for those upcoming public hearings.
