Board declines change to 'public utility' definition; planning commission recommendation accepted

The board considered a proposed zoning text amendment to add explicit language ("solar") to the countydefinition of "public utility." Planning staff and multiple speakers summarized the planning commission process: the planning commission had voted 8–0 to reject adding solar to that definition.

Planner (Speaker 4) explained the planning commission's view that existing language—references to electricity and generation—already allows the county to treat certain solar facilities as public utilities where appropriate. Brian Thomas (speaker 16), a planning commission member who spoke at the public hearing, argued that traditional public utilities provide a direct service to customers (billing and customer service) and that solar farms function differently. Counsel and the applicant also described applicable state statutory language for 'substantially in accord' determinations.

After board discussion, one supervisor moved to accept the planning commission recommendation to leave the definition unchanged; the board voted to accept the recommendation. Members noted that if clarifying language is later needed, staff or the commission may bring a narrower amendment back for consideration.
