County Clerk Brenda Wiseman presented a written report from Fiduciary Commissioner Jennifer L. Morgan concerning a contest by John M. (Michael) Farley of a $25,000 bequest in the will of Thomas D. Gardner. Morgan wrote that, "I am unable to interpret a Will, therefore I deny this claim on jurisdictional grounds," and recommended Mr. Farley file a petition in the Circuit Court of Randolph County to pursue the matter because the fiduciary commissioner lacks authority to interpret the will. The Commission accepted the recommendation as submitted.
The record shows the decedent died March 15, 2024 and the estate was ready to close pending resolution of the contested claim; Morgan advised that Mr. Farley should seek legal representation and file immediately if he wishes to pursue the matter in Circuit Court.
