The Seabrook Board of Adjustment voted May 27 to grant a variance for 4 Cross Beach Road, allowing front stairs within the 20-foot setback and granting a requested 40-foot building height in Zone 1. Applicant Paul Lepere presented plans and told the board the property is impacted by changing ocean levels: "Paul explains that the ocean is rising and lowering." The board found the variance satisfied the required five criteria and approved the motion (moved by Rick Foye; seconded by Fidea Azouri); Bob Larochelle was recorded as opposed.
The written notice of decision attached to the meeting record states the approval expires if the work is not completed within two years and that compliance with the notice conditions must be met before a building permit can be issued. The board’s findings included determinations that the variance is not contrary to the public interest, that the spirit of the ordinance is observed, that substantial justice would be done, that surrounding property values would not be diminished, and that literal enforcement would result in unnecessary hardship.
