The City of Fairview Planning Commission voted July 28 to recommend that City Council adopt Ordinance 04-2026, which would remove the storefront-district overlay from two parcels at the NE corner of Fairview Parkway and Halsey Street. City staff said the amendment will not change the underlying Town Center Commercial zoning but will remove an overlay requirement that previously limited ground-floor residential and mandated specific storefront design elements.
City planner Alex (staff) told commissioners the overlay “was implemented in 2022 as part of a larger code project” and that removing it “will not change the existing underlying zoning, which is town center commercial.” Staff emphasized the amendment removes a requirement that ground-floor commercial equal at least 50% of frontage and several overlay design standards such as window percentages and pedestrian plazas. Staff recommended the commission forward the proposal to council for adoption.
Public testimony included remarks from the property owner’s representative, who argued market conditions have left storefronts vacant and that removal could make housing development more viable. After commissioners debated vacancy, parking and economic viability, a motion to recommend adoption (option 1) carried on a roll-call vote with all commissioners voting yes.
