President Lisa Pelosi opened the meeting at 10:00 a.m. and later reported that the board "participated in a discussion and gave the consultants direction" regarding item 5A, the superintendent appointment (Government Code 54957).
The closed-session listing in the agenda identified the matter as "PUBLIC EMPLOYEE APPOINTMENT/EMPLOYMENT: SUPERINTENDENT (GOVERNMENT CODE 54957)." The board did not report a formal appointment or an open-session vote on the superintendent during the meeting; President Pelosi's report out stated the board provided direction to consultants but recorded no final action in public. The meeting record lists Trustees Jeannie Kerr, Lisa Pelosi, Shawn Moura, Jeanmarie Wolf and Trustee Laura Symon as members present at various points during the meeting.
Because personnel appointments for public employees are handled in closed session under California law, the board's discussion and its instruction to consultants occurred outside the public record for deliberations.
