President Marilyn Shepit read Attorney Shaw’s guidance to the board: "The Village is subject to the 2015 Life Safety Codes, but the building at 3205 Lakeside Court was constructed pre 2015 and there is no requirement that he is aware of that would require retro-fitting. Also the Village cannot require sprinkles as a practical matter due to the residents being on wells. It requires a pressure tank and other systems which are notoriously unreliable." After that explanation Trustee Zakrocky asked whether the village could be held liable; Shepit said the property is grandfathered and the village would not be liable. The board approved the verbal waiver by voice vote with all present trustees voting yes.
