Lincoln County commissioners reject temporary moratorium on data center development

At a June 8, 2026 meeting in North Platte, the Lincoln County Board of Commissioners voted 3‑2 against adopting Resolution No. 2026‑21, a proposed temporary moratorium on the development of data center facilities.
Commissioner Micaela Wuehler moved to adopt the moratorium and Commissioner Jerry Woodruff seconded the motion. After discussion and an amendment attempt, the roll‑call vote recorded Commissioners Wuehler and Chair Kent Weems voting "aye" and Commissioners Chris Bruns, Jerry Woodruff and Joe Hewgley voting "nay," causing the measure to fail.
The discussion followed a county planning training in Kearney. Commissioners said the session left them with more questions than answers about how to define and regulate "hyper‑scale" data centers. Wuehler told colleagues she would "like to see a pause" while the county evaluates whether current rules are adequate. Chair Kent Weems said he wanted greater transparency from developers and "to see the actual economic value to the county." Commissioner Hewgley said he is pro‑business but emphasized that regulations should be carefully considered and applied with conditions to protect the county.
County Planning Director Judy Clark told the board that Lincoln County already has zoning regulations, a comprehensive plan and soil overlay districts that can impose conditions on a proposed project, but she also said the county could adopt additional regulations. Clark said she was "looking at August" as a target for drafting any updates and explained that state law creates a statutory "shot clock" that limits the county's review time on certain applications.
The minutes record that there were no current data center applications before the county. Public comments on data center development were received and are listed in the minutes from seven speakers: Becky Cudzilo, William Wood, Nancy Nelson, David Huebner, Martin Mora, Shaylee Scranton and Paige Zogg; the minutes do not include verbatim text of those remarks.
Planning committee members will collect additional data and return recommendations to the board. No formal regulatory change was adopted at the June 8 meeting.
